Is anyone else having trouble getting a form 1042S from Smashwords? This is the form they are required to send to foreign authors when they have withheld tax from them. The deadline, according to the IRS, was March 15th. I haven't gotten mine, and haven't been able to get any kind of answer from Smashwords about why not or when the forms might be available other than "soon". I've been emailing them every week or two for months and gotten nothing but "soon". No explanation, no estimate of when, nothing. Amazon furnished this form in late February, but I can't file my US tax claim to get the money back until Smashwords comes across with the form. It's extremely frustrating.

Is there a reason you chose not to file an ITIN with Smashwords or Amazon?

Well, in fact, it took some time to get the ITN. I sent in the form to the IRS 3 times, and it was rejected 3 times (after several months delay each time). Apparently they didn't recognize my ID. I finally had to go and get a passport and get that notarized at the embassy before they would process my form and send me the ITN. I filed it with Amazon and Smashwords towards the end of the year. However, in the interim, they both withheld 30% of my royalties for taxes. Amazon has supplied my form. Smashwords has not, and all attempts at eliciting why or when have failed.
I have to say that previous to this Smashwords has been great in communicating with me on issues which have arisen. Mark has emailed me several times in response to questions. But on this issue he's just not replying.

Argus, I know about rejection. My ITIN was rejected by the IRS several times as well, as the copy of my passport picture was not clear thanks to the security against copying imposed by the passport itself. Problem was the IRS wanted a copy of something that was designed not to be copied.
Mark's a busy man so I generally don't email him and instead just use the support ticket system. You might be faster just mailing a letter to their office.
